APPLICATION FOR PROBATION

Accused, Dexter L. Santos, hereby applies for probation under the provisions of PD. NO. 968 and declares:

  1. That the accused is of legal age, married, and a resident of Brgy. Wawa St, San Fernando, Bataan;
  2. That he has been convicted of the crime of ‘VIOL. OF SEC. 16 ART. III OF R.A. 6425” as amended and was sentenced to suffer the penalty of six (6) months to two (2) years, four (4) months and one (1) day;
  3. That he has not began to serve the term of imprisonment imposed against him;
  4. That the crime for which he has been convicted is not an offence against the security of the state;
  5. That he has not been previously convicted by final judgment of any offense punished by imprisonment of not less than one (1) month and one (1) day and/or a fine of not less than Php500.00;
  6. That he has not been once on probation under the provision of PD 968 as amended.

That I, AIKO HERRERA SANTOS, married, of legal age, Filipino and presently residing at Wawa Abucay, Bataan, after having been sworn to in accordance with law, hereby depose and state:

  1. That I was legally married to Jomari Santos on February 28, 2005 at Abucay, Bataan;
  2. That, per the Certificate of Registration and Official Receipt of my vehicle identified as NISSAN BLUEBIRD with Plate No. PTT-421, my status then is SINGLE and using the name AIKO M. HERRERA as my maiden name;
  3. That the names AIKO HERRERA SANTOS and AIKO M. HERRERA refers to one and the same person;
  4. That, I am executing this affidavit to attest to the truth of the statements and for other legal purposes that this may serve.
