You are immediately assume office upon taking your oath as required by law. However, this appointment will be automatically cancelled and considered null and void if you are related to any candidate or to any member of the Board of Election Tellers of said precinct/s within the fourth civil degree of consanguinity or affinity. In such case, you shall not assume the duties of the office and shall immediately return this appointment to the Election Officer. Assumption to the office notwithstanding this prohibition is punishable under the law.

Sample Vaccine Refusal Letter

Good day!

I am writing this letter to once and for all answer the inquiry on my personal decision not to be vaccinated. I would like to inform you that I am fully aware of my decision against being vaccinated against Covid 10 and I expect that my decision be respected for these reasons.
First, my right to exercise my right to life is recognized by our Constitution, Under Art. II Sec. 11 and Art. 3 Sec.1 of the 1987 Constitution is the pertinent provision to this. It there is anything that may endanger my life, I am law fully allowed to protect myself from whatever means and I am allowed by law to sue and claim damages against anybody who may want to cause me harm. Under the equal protection clause of the Constitution of the same provision, the distinction must be germane to the purpose. If your intention of requiring me to be vaccinated in order to prevent transmission, then that purpose is not relevant to the reason for your requirement. Both vaccinated and unvaccinated persons are susceptible to infection and transmission.

Second, under Labor Advisory No. 08 Series of 2021 issued by the Department of Labor and Employment, my refusal to get vaccinated should not be taken against me nor should it be a cause for discrimination in terms of tenure, promotion, training, pay and other benefits among other, nor should it be cause for termination from employment. The Advisory is clear, a “No vaccine”, no work policy shall not be allowed.”
If I, for any reason be discriminated against because of my decision, I will have to no choice but to seek legal action and will fight this up to the full extent of the law. If you must insist otherwise, I will be glad to provide you the name and contact information of my lawyer.

I am Shella May Quinto, grade 11 students, seeking exemption from the Covid 19 Vaccination Card as an enrollment requirement to face to face classes for the following reasons:

As stated in Republic Act 11525:

(1) The Covid 19 Vaccine is experimental, (Section 2)
(2) Nobody is liable if I get injured from the experimental vaccine (Section 8)
(3) The vaccine card shall not be used as a mandatory requirement for education. (Section 12)
(4) Individuals vaccinated against Covid 19 as indicated in the vaccine card shall not be considered immune from Covid 19.

I have attached a copy of an advisory letter that I sent to our LGU which I also mailed to the Supreme Court and the Department of Justice. A copy of RA 11525 is also attached for reference.

Any form of coercion would be penalized under Revised Penal Code Article 286 “Grave Coercion”.

What are the two ways of committing Grave Coercion?

  • By preventing another, by means of violence, threats or intimidation, from doing something not prohibited by law.
  • By compelling another, by means of violence, threats or intimidation, to do something against his will, whether it be right or wrong.

Antigen Test Refusal Letter

Greetings:


I am writing this letter in response to your requirement for my continued employment to undergo regular Covid 10 testing. I would like to remind you that such requirement is a clear violation of the DOLE advisory No. 3 Series of 2021. It is a circumvention of the said advisory and is tantamount to discrimination

For your understanding, requiring me to undergo regular testing because I am not vaccinated is discrimination in the same sense that is described by the DOLE Advisory. If your intention is to curb down the chances of infection in the office, you should also require the same to vaccinated personnel. Take note, that even vaccinated persons can be carriers, they can also be infected and can transmit the virus.

Under the EQUAL PROTECTION CLAUS of our constitution, such distinction must be relevant to the purpose of the law. When the DOLE does not distinguish vaccinated and unvaccinated as protected under our Labor Laws, it also means, that you cannot impose anything against me for the simple reason stated in the above-paragraph.

If I continue to be discriminated because of these requirements, or if you are forcing me to resign because I do not want to be discriminated in the workplace, not only will I get the services of my lawyer to sue you for UNFAIR LABOR PRACTICE but also sue anyone who is using their authority, position or power to force me to do something that I do not want to do, whether you appreciate it as good or bad, with a criminal case for GRAVE COERCION.
